Chapter 9.08 BARRIERS FOR SWIMMING POOLS, SPAS AND HOT TUBS
9.08.040 Design.
The enclosure shall be constructed to the following standard:
A. The
top of the enclosure shall be a minimum height of sixty (60) inches above grade
measured on the side of the enclosure that faces away from the swimming
pool;
B. Any access gates through the enclosure shall open away from the
swimming pool, be self-closing and self-latching with the device placed no lower
than sixty (60) inches to grade;
C. The maximum vertical clearance from
grade to the bottom of the enclosure of two (2) inches;
D. Gaps or voids, if
any, do not allow passage of a sphere equal to or greater than four (4) inches
in diameter;
E. An outside surface free of protrusions, cavities, or other
physical characteristics that would serve as handholds or footholds that could
enable a child below the age of five (5) years to climb over; and
F. Where a
wall or walls of a private, single-family dwelling serves as part of the
enclosure and contains door openings between the dwelling unit and the swimming
pool that provide direct access to the swimming pool, one or more of the safety
features meeting the requirements of Section 9.08.030 (A) through (E) shall be
