Chapter 6.09 GARBAGE

6.09.180 Recyclable materials collection removal.

Collection; Fees.

The City Council is authorized to do each of the following:

1. To determine how and by whom services concerning the collection, processing and marketing of recyclable materials within the City of Monte Sereno are to be provided, including but not limited to the entering into of an Agreement with a person, firm, partnership, or corporation (referred to as "person") wherein the exclusive or non-exclusive right and privilege of collecting, processing and marketing recyclable materials from designated dwellings within the City would be granted subject to compliance with the Agreement.

2. To determine by Resolution the amount of any fee to be imposed and collected from the residential occupancies to be served by any recyclable material collection program provided by the City of Monte Sereno or by any person with whom the City has contracted for such services, together with the manner in which the fee is to be collected.

A. Removal; Exception.

1. No person other than the person with whom the City has entered into an Agreement to provide services for the collection, processing and marketing of recyclable materials shall remove any recyclable materials which have been segregated from other refuse, placed in designated containers separated from refuse and placed at a designated collection location for purposes of collection and recycling.

2. Nothing contained in this Chapter shall limit the right of any person to donate, sell, or otherwise dispose of any recyclable materials which that person owns.
