Chapter 6.01 ANIMAL CONTROL

6.01.100 Authority of City Manager and Animal Control Officer.

The City Manager and animal control officer shall have the following power and authority:

To enforce the provisions of this Chapter and state laws relating to the care, treatment, impounding and destruction of animals.

A. To arrest any person who violates any provision of this Chapter in the manner provided by Section 836.05 of the Penal Code.

B. Animal control officer to issue citation pursuant to Section 607(g) of the Civil Code.

C. To act as a public officer pursuant to Food and Agricultural Code Section 7.

D. The City Manager may formulate rules and regulations in conformity with and for the purpose of carrying out the intent of this Chapter. Such rules and regulations shall have the same force and effect as this ordinance when adopted by the City Council and any violation shall be deemed an infraction.

E. Pursuant to Civil Code Section 607(g), the City Manager may deputize as an animal control officer any humane officer of the Humane Society of Santa Clara Valley.
